Patient Right to Know Drug Prices Act

& The Know the Lowest Price Act


Independent pharmacists and their advocacy groups have been trying to educate the public and the media for decades about PBM practices. Some practices seem at odds with the interests of employers (payers) and the patients being served. Unfortunately, trying to explain DIR fees, MAC tables, rebates, copays, and network contracting issues isn’t easy. Washington has heard these messages over time. Secretary Azar has made several comments and acted on gag clauses even before this bill was signed by President Trump.

On October 10, 2018, both bills became public law. Pharmacists are now free to point out something that is in the patient’s best interest: out of pocket costs can be lower than PBM copays. This is great for patient’s transparency. Hopefully this will begin a legislative agenda that is pro independent pharmacy. However, this does not stop a PBM from telling you who you can be a provider for or mail to, burdening you with performance rating and DIR reconciliation issues, and constant erosion of margins. Hopefully the independent pharmacy industry and advocacy groups will use this foothold as the first step towards more comprehensive legislation that impacts the bottom line positively for the long term.
